Sikkim Becomes India’s First “Paperless” State Judiciary

In an historic move toward digital governance and modernization of the judicial process, the state of Sikkim in the northeast region of India is the first “paperless” state judiciary in the country. This is a groundbreaking evolution in the Indian legal process, indicating how technology can speed up and enhance the process and even make it environmentally friendly. This is a pioneering move for Sikkim and indeed for courts in the whole country.

A paperless judiciary essentially means that all the court process, filing, documentation, and communication will be carried out electronically rather than manually using paper documents. The Indian judicial system has been based on the extensive use of paper documents, which created large volumes of files and delays in the process. With the move to a totally electronic system, Sikkim has made huge strides in the judicial field.

This is in line with the wider e-Courts Mission Mode Project that was launched by the Government of India under the supervision of the Supreme Court of India. While other states have adopted technology to enhance efficiency in their courts, Sikkim is at the forefront, becoming the first state in the country to attain full paperless functionality within its judiciary.

With the new system, advocates will not need to physically visit the court offices to file cases since they will be able to file their cases using e-filing facilities. Files of cases in the court will be saved digitally, and the judge will be able to access the documents from computers or tablets. Orders/judgments will be saved digitally, and this will make it easier for litigants and lawyers to access the information. Litigants will even be able to attend proceedings virtually from remote locations.

The biggest benefit of having a paperless judiciary is that there will be less wastage of time when dealing with files. The movement of files from one office to another takes up precious time; however, with the digitalization process, there will be no need to do so anymore since everything is handled virtually.

Additionally, the project has a very positive impact on the environment. Huge volumes of paper are consumed by Indian courts yearly. Such a great amount of resources causes deforestation and waste production. Therefore, thanks to a reduction of paper consumption, the courts in Sikkim contribute to environmental preservation and sustainable development. Taking into consideration that the state of Sikkim is renowned for its beautiful nature and environmentalism, the establishment of the paperless judicial system suits it perfectly well.

It is worth noting that another advantage of this innovation is an increased accessibility of legal help for the citizens. People can learn about any important data concerning courts without the necessity of several visits to the court office. In addition, attorneys have the opportunity to work with all legal documents remotely. It will definitely be helpful in such a mountainous state as Sikkim.

The positive experience of the Sikkim judiciary also illustrates the importance of embracing new technology by public institutions. An essential element of this process is training people who are working there. Judges, court clerks, and attorneys underwent training in order to master all necessary skills and technologies successfully.

Legal professionals and policy makers from all over the country have highly appreciated this development. It is said that the initiative will serve as a role model for the rest of the nation to follow. In fact, the use of modern day technologies like digital filing, hearing, and documentation will prove helpful in speeding up the process of justice delivery as the number of pending cases continues to rise all over the country.

Conclusively, Sikkim's emergence as the first digital state judiciary of the country is indeed an important step in the journey of law and technology in India. This move has brought about great efficiency, transparency, sustainability, and innovation in Sikkim's judiciary. It has not only made life simpler for the people here but has also shown a path for others to follow.

Tamil Nadu’s High Court Impeachment Controversy: A Constitutional Storm

Early in December 2025, the Lok Sabha Speaker received a notice from more than 100 Members of Parliament (MPs) from the INDIA bloc and several opposition parties, including the Dravida Munnetra Kazhagam (DMK), requesting the impeachment (constitutional removal) of Justice G.R. Swaminathan, a Madras High Court judge.

The motion concerns accusations of misconduct and bias associated with Justice Swaminathan's contentious decisions, particularly an order pertaining to the lighting of the Karthigai Deepam lamp atop a hill next to a temple and dargah in Thiruparankundram (Madurai). Opponents contend that the order represented discriminatory overreach and upset religious peace.

231.1) Why is this Controversy Significant?

Judges of the Supreme Court and High Court may be removed for demonstrated misconduct or incapacity under the Indian Constitution, however the standard is quite high:

1) Before a motion is accepted by the presiding officer, it must receive the support of at least 50 Rajya Sabha MPs or 100 Lok Sabha MPs.

2) A three-person inquiry committee looks into the allegations upon admission.

3) Both Houses of Parliament must approve the proposal with a special majority (two-thirds of present members and an absolute majority of the entire membership) if the committee finds evidence of misbehaviour.

4) Lastly, the judge's removal is legally ordered by the President.

In India's history, no High Court judge has ever been successfully impeached. In order to safeguard judicial independence and avoid political abuse, the procedure is purposefully challenging.

231.2) Why MPs moved the motion?

Leaders of the DMK, Congress, Samajwadi Party, and other opposition MPs contend that Justice Swaminathan's ruling in the Thiruparankundram Deepam case was not only legally incorrect but also demonstrated prejudice and poor judgement that damaged religious peace and public order.

The motion's proponents believe that when judges deviate from the values of impartiality and fairness, they can be held accountable through the constitutional process of impeachment.

231.3) Backlash and Support

231.3.1) Strong Reaction from the Legal Community and Judiciary:

The impeachment notification sparked a significant protest from the courts as well as from political rivals:

1) In a public statement denouncing the impeachment attempt, 56 former judges—including retired Supreme Court justices and previous Chief Justices—called it a "brazen attempt to browbeat judges who do not fall in line with ideological expectations" and a threat to judicial independence.

2) In a memorandum rejecting the impeachment motion, senior advocates and attorneys at the Madurai Bench contended that it is an abuse of the impeachment process and threatens the constitutional division of powers.

The Tamil Nadu legal community has defended Justice Swaminathan's ruling, arguing that it was founded on legal logic rather than personal prejudice.

231.3.2) Political Rebuttals to Accusations

The conflict has been extremely politicised:

1) BJP leaders declared the action "unconstitutional" and accused the DMK and opposition parties of using impeachment as a political tool.

2) The impeachment movement's detractors contend that it creates a risky precedent in which judges could be politicised for rulings that are unpopular with influential groups.

3) The DMK was also accused by some BJP state leaders of selectively adhering to court orders in order to further their political agendas.

231.4) Context: The Deepam Row

The Karthigai Deepam lamp row itself involves delicate points where politics, tradition, and religion converge. Tensions between different religious groups in Tamil Nadu have been stoked for decades by the question of whether a specific community was permitted to light the lamp next to a temple and near a dargah. Critics viewed Justice Swaminathan's order as upsetting long-standing customs in the community, but proponents maintain that his ruling followed the law.

231.5) What Happens Next?

1) Although a notice of impeachment has been filed, it has not yet been accepted or discussed in Parliament. The Speaker's procedural examination will determine whether it is admissible.

2) The constitutional impeachment procedure, which entails committee investigation and possible parliamentary voting, will start if the candidate is admitted.

3) Moving forward with impeachment is still a difficult undertaking due to the high constitutional threshold and strong opposition from previous jurists and legal bodies.

231.6) Why This Matters?

This dispute touches on core tenets of Indian democracy and is not limited to a single judge:

1) Accountability vs judicial independence

2) Constitutional mechanisms become politicised

3) Separation of powers between the judiciary and the legislature

4) Public trust in establishments

Future developments in India's constitutional system may depend on how Parliament, the judiciary, and the legal profession handle this matter.

DHARMASTHALA BURIALS CASE

AI GENERATED

A case of India which has completely shook the judiciary and administration of state . Here , I am talking about the Dharmsthala case of Karnataka . On July 17, 2025 a sanitation worker of the temple regime , who had worked between 1995 and 2015 , claimed that there were more than 100 bodies buried in the temple regime .

The Dharmasthala is one of the most pious places of Karnataka . The temple region is run by an influential family .

According to the sanitation worker , among the buried bodies , more than 100 bodies were of ladies which were mostly students . They were brutally raped in such a way that many of girls were buried nakedly . Many of the girls were buried in school uniforms .He gave pictorial evidence of this heinous crime. It is expected that Sujata, mother of an MBBS  student who has been missing since 2003, is demanding an SIT probe . Many of the famous lawyers had supported her.

According to his complaint, he was regularly threatened with death if he refused to comply, with supervisors warning, "We will cut you into pieces, your body will be buried like the rest”.

He also said that many of the burials were thrown in the Netravathi river . The Whistle-blower told that he was forced to bury many girls of ages 15 to 21. He was very frightened when a girl belonging to his Family was kidnapped and killed for the same purpose .

The Whistle-blower had got security under Witness act of 2018. While Court is discussing for the probe. The heinous crimes probe is very necessary .  It is not clear that the heinous crime was happened Or not

After looking such crimes, I only want to say that we are dreaming for viksit bharat while such events Completely ensures that there Is lack of empathy I'm our nation. Instead of serving our younger generation, we are burying them.
