Article 371(K): A New Constitutional Shield for Ladakh

The inclusion of a new clause known as Article 371(K) for Ladakh by the Center is one of the major developments in the context of changing federal structure of India. The new clause aims at providing constitutional security for the UT as well as forming a directly elected institution which would have the authority to make laws related to various matters of local significance. It was done keeping in mind the demands of various civil society organizations in Ladakh.


504.1) Why Does Ladakh Need Special Protection?

Ladakh emerged as a Union Territory without a legislature in 2019 after the restructuring of erstwhile Jammu and Kashmir. While Jammu and Kashmir maintained its legislative assembly, Ladakh was to be governed mainly through the office of the Lieutenant Governor and the administrative machinery.

Therefore, certain apprehensions were expressed by people regarding their political representation and involvement in governance.

Consequently, there have been demands from Leh Apex Body (LAB) and Kargil Democratic Alliance (KDA) for constitutional guarantees. Some of these include guarantees in respect of lands, employment, culture, languages, environment, and natural resources. In addition to these, the people have demanded greater political autonomy and at different points of time, even statehood and inclusion in the Sixth Schedule of the Constitution.


504.2) What Is Article 371(K)?

Article 371(K) is meant to be a sui generis or unique constitutional scheme meant particularly for Ladakh. It will find itself enshrined in Part XXI of the Constitution, which has special provisions for certain states and regions.

One of the prominent elements of this constitutional scheme is an elected Union Territory-level legislature. Such a legislature is supposed to legislate in respect of certain subjects, which could include land, language and culture, forests, environment and natural resources. It can also exercise powers with respect to certain subjects that come under the jurisdiction of the president by virtue of Article 240.

In short, the attempt here is to achieve a fine balance where Ladakh continues to be a Union Territory but at the same time gets more democratic representation.


504.3) Article 371(K) vs Sixth Schedule

The significance of the proposal lies in its being an alternative to the age-old call for the Sixth Schedule status.

While the Sixth Schedule offers considerable autonomy via autonomous district councils, especially in the tribal areas of the Northeast, Article 371(K) can become a Ladakh-specific constitutional model that can take into account both the legislative powers and the peculiarities of the unique cultural, ecological and land interests of the region.

Through such an arrangement, the Centre can not only retain the strategic value of Ladakh as a sensitive border UT but also accommodate the calls for local autonomy.


504.4) Conclusion

This proposal, nonetheless, is still at an early stage. Reports show that there has been no presentation of the draft Article 371(K) yet, and there are still many important issues to consider, such as executive powers, funding, planning, policing, and public order.

The future of this proposal will depend on whether it can offer actual autonomy and not just representation. For Ladakh, the issue is not merely one more constitutional article; the challenge lies in striking a balance between democracy, development, ecology, culture, and national security.

In well-considered form, Article 371(K) would be able to offer a unique model of asymmetric federalism in India—a constitutional guarantee for the region without the need to alter its current Union Territory status. It would possibly change the dynamics between the region and the Centre by offering protected and participatory governance after years of political instability.
