Leh, August 29, 2026: In a major step towards ensuring easier access to justice in the Union Territory, President Droupadi Murmu promulgated a regulation on August 27, 2026, laying down provisions for making the establishment of a sitting bench of the High Court of Jammu and Kashmir and Ladakh in Ladakh possible. The provision, which seeks to bring closer judicial remedies of a higher level, would benefit the strategically important and difficult-to-reach Himalayan state.
The regulation, named the Union Territory of Ladakh (Sitting of Bench of the High Court of Jammu and Kashmir and Ladakh in Ladakh) Regulation, 2026, has been notified by the Ministry of Law and Justice as Regulation No. 10 of 2026. It has been issued under Article 240 of the Constitution in conjunction with Section 58(2) of the Jammu and Kashmir Reorganisation Act, 2019.
491.1) A Major Step Towards Accessible Justice
Ladakh was demarcated as a separate Union Territory in the wake of reorganisation of the former State of Jammu and Kashmir in 2019. Nevertheless, the Union Territory remained to be part of the High Court of Jammu and Kashmir and Ladakh. In such a way, until recently, the lack of a process enabling regular sessions of the High Court in Ladakh has created certain challenges for individuals seeking legal redress from the High Court.
This particular ordinance aims to bridge this loophole. In accordance with this ordinance, Judges and Division Courts of the High Court may sit at some place or places within Ladakh. The particular place of sitting is to be fixed by the Chief Justice of the High Court with the approval of the Lieutenant Governor of Ladakh.
From the point of view of an ordinary individual, the importance of the decision lies not only in the structural changes. Ladakh possesses quite a large geographical area, altitude, cold climate and poor infrastructure. Traveling to Jammu or Srinagar may prove to be both difficult and costly.
491.2) What Will Change?
The law does not provide for the creation of a completely different High Court for Ladakh. Instead, it lays down a legal basis whereby the already extant common High Court of Jammu and Kashmir and Ladakh can hold sittings in Ladakh. The principal seat of the High Court will not change under any circumstance.
On the other hand, it still remains within the power of the Chief Justice to direct that some particular cases emanating from Ladakh can be decided in Srinagar and Jammu, where the case may lie.
491.3) A Long-Standing Demand
The move has been appreciated by the Ladakh administration as the realization of a longstanding wish of the people of the region. Lieutenant Governor Vinai Kumar Saxena has stated that this is an important move in terms of justice being brought to the people. The Ladakh administration further pointed out that the regulation has been made within seven days after the Union Cabinet's announcement on the move, thereby showing the speedy implementation of the decision at the regulatory level.
The move will have wider implications for the lawyer community in Ladakh. The local lawyers will gain an advantage of representing their clients in front of the High Court judges without having to travel out of the Union Territory frequently.
491.4) Conclusion
While the regulation has already been issued, the bench would not automatically start working right away. This is because the regulation states that it would come into effect from a day notified by the Administrator of Ladakh in the Official Gazette. The administrative steps such as identification of the place where the bench would sit and the schedule of hearing cases will thus follow.
Setting up of a bench of the High Court in Ladakh is more than merely building another judicial body. In fact, this is an acknowledgement that geography should not become an obstacle to seeking constitutional remedy. As Ladakh develops as a Union Territory, setting up of the higher judicial machinery in close proximity to the residents of Ladakh would constitute an important step in this direction.
Ladakh is thus going to make a big leap from the heights of the Himalayas to the corridors of justice.
