Now a days our honorable supreme court is giving very landmark decisions which are very important for our daily life. Few weeks ago, Supreme court gave famous decision regarding Harish Rana case which was regarding euthanasia. Similarly, on Tuesday supreme court said that the mothers who have adopted the children and are doing any work in any organized sector like industry, public sector undertakings etc. must have the right to get at least 3 months maternal leave. current law doesn’t define the maternity leave for the adopted mothers. This decision was again given by Justice J.B. Pardiwala and Justice Mahadevan. The Juvenile Justice Act and Labor code in India suggests that if a parent wants to adopt a child, then he or she must live with at least 2 months with child so that they must understand the instinct of each other but the child must below the age of two years. After it the child will be declared as legally free and the child will have the rational connection with their adopted parents. They also mentioned the article 21 of the constitution that “Reproductive autonomy cannot be narrowly understood as being limited to biological reproduction alone”. The court said that this law denudes the right of such mothers who are non-biological in nature but want to adopt a child and live their life which is full of dignity, integrity.
This decision of supreme court will be beneficial for those women who
want to work in industry but doesn’t want to give birth to a child. Adoptive
parenting will take a new role after this decision.
