Delhi High Court Grants Conditional Release in Unnao Rape Case

In the well-known 2017 Unnao rape case, the Delhi High Court rendered a significant ruling on December 23, 2025, suspending former Bharatiya Janata Party (BJP) leader Kuldeep Singh Sengar's life sentence and granted him conditional bail while his appeal is ongoing.




243.1) Background of the Case

The case is related to a June 2017 rape incident in Unnao, Uttar Pradesh, where a young girl was sexually attacked. In December 2019, a trial court found Sengar guilty of the crime and sentenced him to life in prison. Due to the seriousness of the crime, the participation of a governmental figure, and other related circumstances, such as the survivor's father's death, which the courts determined happened while the victim was in detention, the Unnao rape case has received extensive media coverage.


243.2) High Court's Decision

Justices Subramonium Prasad and Harish Vaidyanathan Shankar, who make up the Delhi High Court's division bench, halted Sengar's life sentence and granted him bail while he appealed his conviction.

Nevertheless, there are a number of stringent requirements for its release, such as:

1) Sengar is required to provide three sureties totalling ₹15 lakh in addition to a personal bond.

2) He must stay in Delhi's National Capital Territory and cannot leave without a judge's prior approval.

3) The court is to receive his passport.

4) Sengar is required to report to the police station once a week.

5) He is prohibited from contacting, influencing, or intimidating the survivor or prosecution witnesses, as well as from going within five kilometres of the survivor's home. 

The court made it clear that the sentence suspension does not amount to an acquittal; rather, it is solely provisional and pertains to the rape conviction pending appeal.


243.3) Reactions and Legal Challenges

The survivor and her family have expressed severe disapproval of the choice. The survivor has expressed plans to contest the High Court's ruling in the Supreme Court, citing political influence as the reason for the decision, and has called the bail a disturbing development.

Additionally, the Central Bureau of Investigation (CBI) has said that it will petition the Supreme Court to contest the bail order and the suspension of Sengar's life sentence.
