A few days ago , the Madhya Pradesh High Court allowed an 11 year old child to take admission in class 9. This decision was given by Justice Vishal Mishra. In his decision he said “ right to Education cannot be curtailed by imposing a condition regarding age limit ”.

  In this case the petitioner was denied admission by the authority of that cbse board school. He was pressurised to amend his age in transfer certificate .After that , he filed a petition in the high court of Madhya Pradesh regarding his admission in the school.

But the Central Board of Secondary Education gave them a description and criteria regarding the age and class of the younger ones eligible for taking admission in 9th class. 

Clause 6.1(a)(11) of board examination laws says that “ Students would be eligible for admission to a particular class only if he/she satisfies the requirements of age limits as determined by the state government and Union territory. There will be no age relaxation in any condition”. While subsection 1 of clause 4 of national education policy -2020 says that Learning should be enjoyable , holistic , integrated and engaging . It also talks about circular and pedagogical structure (5+3+3+4 design) which are as follow :

Here 5 understands for children at foundation stage will be considered between the age group of 3 to 8 years . In this, students will spend about 3 years in anganwadi or pre group school while next two years will be in primary class (1 & 2) .

3 stands for children at the preparatory stage . They lie in the age group of 8 to 11 years . Their grades start from 3 to 5. 

3 stands for children at the middle stage .They lie in the age group of 11 to 14 years . Their grades are 6 to 9.

4 stands for children at the Secondary stage. They lie in the age group of 14 to 18 years. Their grades are 9 to 12. 

So , NEP also says that the student must be at least 14 years old to take admission in class 9 .

In January 2024 , A 10 year old boy was permitted by Patna high court to sit in class 10 board exam for 2025 . This decision was made due to a loophole in the rules of the Bihar education board .

In March 2022 , the Himachal Pradesh high court allowed an 8 year old boy to study in class 8 (because his IQ was 128) .

In September 2021 , Madras High Court allowed a 16 year old boy to sit the NEET exam (IQ 143) . 

According to various child specialists and psychologists , the theory of IQ should not be the basis for such decisions. Child development is relative , school education is not just about academics but also about a setting where students interact with peers of the same group. Their physical and mental development is done during that age .
